Terms and rules

All members accessing the Sunbeam Talbot Darracq Register Forum and Gallery acknowledge that they have accepted the following rules - to which they agreed when they registered:


Forum/Gallery Rules (Updated March 2025)

Access to the Sunbeam Talbot Darracq Register (STD) Forum and Gallery is free of charge and is available, by Registration, to Members of STD. STD requires that all users abide by the Rules. In the text below, all conditions apply equally to posts, images and information uploaded to and commented on in the Forum and in the Gallery. (From this point onwards, where the text refers to the ‘Forum’, the text will also apply to the Gallery. The term ‘Forum’ means both the Forum and the Gallery).

The Forum is provided for the benefit and enjoyment of STD Members, and it is provided in the understanding that Members posting and uploading to the Forum will do so respectfully and courteously.

Although the administrators and moderators of the Forum will attempt to remove any inappropriate content from the Forum, it is not possible to review all content as it is posted. The Forum administrators and moderators also rely upon Members to report content that they feel is inappropriate.

Any view expressed in the content is solely the view of the author. Sunbeam Talbot Darracq Register Limited, the website host and the software developers, will not be held responsible for any consequences from any content.

When you register, you will be asked to provide a small amount of personal information, some of which is optional. For clarity, users of the Forum may only share the personal details of other Members, those details being those recorded on the Forum in the Membership section, with other STD Members, and must not divulge, by any media or process, the personal details of Members to any other person or organisation without the explicit permission of those Members whose details are concerned.

You agree not to use the Forum to post any content which is vulgar, defamatory, knowingly inaccurate, harassing, hateful, threatening, invasive of another’s privacy, sexual in nature, or violates any laws.

The Administrators and Moderators of the Forum and Sunbeam Talbot Darracq Register Limited, owners of the STD, have full discretion to decide if a post or upload breaches the prohibited categories listed above and to act as they feel appropriate, including to remove any post or image and/or to sanction the person who uploaded the offending content, post, image or comment.

Members posting on the Forum are reminded to think about the language that they use. Content containing swearing, inappropriate or offensive comments will be removed.

The owners of the Forum may be required to reveal information by Officers of the Law or the Data Protection Registrar in the event of a complaint or legal action arising from posted or uploaded content.

STD reserves the right to delete any content, posted or uploaded to the Forum without providing a reason. However, where inappropriate content is deemed to have been posted or uploaded, an attempt will be made to contact the person submitting the content to inform that person of the reasons for any action taken.

If you find any posts or images that you consider to be inappropriate, please contact the STD administrators or moderators directly.


Advertising. 

The Forum is not to be used for selling goods or services by either trade or private individuals. Such requests should be directed to the Newsletter.

Communicating with STD Officers

Please do not use the Forum as a method of direct communication with the Officers or the STD Register. Any specific enquiries should be made to the Officers of the STD Register directly; their contact details are published in the STD Newsletter.

Do Not Register for Access to the Forum if you are under 16 yrs of age.

To comply with UK laws on digital contact with young people under 16 years of age and to comply with similar legislation in other countries, the Forum is not to be used by anyone under the age of 16 years old at the date of registration.

Basic Guidance on Copyright and Intellectual Property Rights

·      Intellectual Property rules cover ‘activities of the mind’, including thoughts, designs, methods and ideas. Copyright is a sub-set of Intellectual Property with rules covering tangible expressions of intellectual property, such as literary and artistic works, including drawings and photographs.

·      Comments and views expressed on the Forum will not infringe copyright or intellectual property laws unless they include substantial components of the intellectual work of other parties quoted verbatim or copied. For guidance, not substantial usually means less than 10% of the total specific piece of work, and components include text, non-photographic images and audio recordings.

·      The copyright of photographs is more complicated and the first things to note are that possession of a photograph does not entitle or infer copyright ownership, and a single photograph can have multiple copyright co-owners and other parties (licensees) with an intellectual, and often financial, interest.

·      Photographs taken before 1944 are generally copyright expired, unless the photographs have licensees (which is rare for old photographs unless part of commercial photo stock holders – see below).

·      The copyright ownership of photographs taken from 1944 onwards is more complex, but in general, the first (original) copyright will be owned by the photographer unless the photograph was taken by an employee, as part of his/her job, in which case the employer will usually own the first copyright. Beyond these two cases, copyright ownership can be difficult to determine; ownership can be transferred (assigned) and where it is genuinely not possible to establish copyright ownership, a photograph is said to be an orphaned work, and then it is possible to apply for an official licence to use the photograph.

·      Copyright protected items can be licenced to other parties and in these cases, although the copyright ownership doesn’t change, the conditions for use do, and often for a financial consideration.

·      For photographs taken from 1944, it is important to either know the photographer or the copyright owner and to have been given explicit permission to upload the photograph, and to acknowledge this ownership in the notes and comments on the Forum/Gallery.

·      Photographers (the ‘author’ not the copyright owner) also have ‘moral rights’ attached to photographs taken from 1st August 1989. These rights are, firstly, the right to be identified as the author of the photograph and, secondly, the right not to have the photograph subjected to derogatory treatment, particularly if this could cause ‘detriment’ to the photographer’s reputation.

·      Photographs held by commercial photo stock companies, such as Alamy Images, Getty Images or Shutter Stock, should never be uploaded to the Forum/Gallery.

·      Posts and comments made on the Forum may contain web-links to other websites and thus to content. In most cases it will not be known if the content in a link is subject to copyright or other intellectual property protection. It is not an infringement to view content on a linked site even if the content itself is in violation of copyright or other intellectual property protection, but it is almost always an infringement of copyright and other intellectual property rights to make a copy of that content – even if only for person later use.

·      Audio content can be uploaded to the Forum. The same copyright and intellectual property rights rules apply to audio content as to other written or image content and are as set out in the ‘Conditions of STD Forum Use’.

·      Currently Video content cannot be uploaded to the Forum. If Members wish to share video content it is recommended that they upload their videos to an external site, such as You Tube, and then provide a link on the Forum. Please remember that the same general copyright and intellectual property rights also apply to video content as well as the terms and conditions of the hosting site (e.g. You Tube).

 

STD Rules for Forum Users

It is not reasonable nor practical for the STD to be held responsible for any copyright or intellectual property infringement liabilities created by Members’ uploads and posts to the Forum. Therefore:

As a Forum user, YOU agree that you will not knowingly post or upload any copyright protected material that is not owned by either yourself or the STD.

YOU remain solely responsible for the content of your messages, posts and uploads, and you agree to indemnify and hold harmless Sunbeam Talbot Darracq Register Limited and its agents with respect to any claim based upon any post you may make. If you subsequently find out that your content is subject to any infringement of copyright or intellectual property protection, YOU must inform the STD Forum administrators at the earliest possible opportunity.


Rules concerning photographs and other content covered by Intellectual Property and Copyright:
Conditions of STD Forum Use


Users who submit to the STD Forum any item that contains intellectual property rights or copyrights do so on the following conditions:


1. The User owns the intellectual property rights and/or copyright, and/or has a copyright licensee’s rights for the item sufficient to and thereby does grant an indefinite non-exclusive royalty free license to Sunbeam Talbot Darracq Limited to allow publication on the Forum, and to allow STD to use the item in its publications, web sites, exhibitions, press releases and in third-party publications, where in the case of the latter, the third-party publisher will acknowledge the Sunbeam Talbot Darracq Register as the source and any copyright owner as appropriate.


2. The User agrees that although the STD will take reasonable care of the digital item, a backup copy should be kept by the User. The STD shall not be liable for any damages, financial or otherwise, resulting from the loss of or damage to an item submitted to the Forum.


3. The STD may use, modify and edit any item submitted, except in ways that would infringe the moral rights of the photographer of any photograph taken after 1st August 1989.


4. The User agrees that for any item uploaded or posted, any other User of the Forum may use that item for their own non-commercial personal use including reproducing it in another form, except in ways that would infringe the moral rights of the photographer of any photograph taken after 1st August 1989, and are granted a non-exclusive indefinite royalty free license for these purposes, on condition that the other User will acknowledge the Sunbeam Talbot Darracq Register as the source and any known copyright owner

These terms may be updated periodically and changed at any time without notice.
